MTN Uganda Dragged to Court Over Illegal Sale of “Kwata Esimu” Song

Singer Free Boy’s real name Adam Mandela’s management VIVA entertainment Limited has engaged MTN Uganda in a court battle on accusations of illegal sale of ” Kwata Esimu” song without their authorization and consent.

In a document seen by our reporter which was submitted to the high court, VIVA demands that MTN Uganda pays them 175million shillings in compensation after the telecom giants have been selling the song to its clients as a caller tune at 700shs each since 2019 without the knowledge of the songs rightful owners.

“An order for account of income earned by the defendant (MTN) from the unlawful sale of the said song to the public and payment of 100{a6adf960b9dc55bb3e49ff07c82daa20469ae533cf096e1b9d27878361bb9db5} royalties,” reads the document reads in part.

The company claim they invested a lot of money in writing, production and marketing of the song but to their dismay, MTN Uganda opted to profit from it without remitting part of the proceeds to VIVA.  “Kwata Esimu” song was sang by Singers FreeBoy and Swangz Avenue’s Winnie Nwagi. It became a hit in late 2019 and in the beginning of 2020.
